This essay considers the appearance of what could be called a “dialectical thomism”, a methodological approach to Thomasian concept of law that intends to stress the importance of dialectics in Aquinas’ theory and praxis of law. This approach seems almost naturally to be alternative, or at least supplementary, as regards analytical thomism today in fashion. Indeed, it results more consonant both with Aquinas’ spirit and with contemporary theory of law, jurisprudence and decisions of the courts.
