Work [unpublished, original, at invitation and subsequent verification of the Curators (... of those Curators)] consider the difficulty of explaining a unitary concept of 'matter' by the listings in art. 117 of the Constitution, introduced in the text following the constitutional amendment introduced by art. 3 of the constitutional Law n. 3/2001. Moving from the observation that it would be wrong to consider comprehensively the provisions of this provision to pretend to analyze the legislative power of State and Regions, the paper analyze the paragraph 4 of art. 117 and the so called 'residual' legislative Power of Regions. It then argues about the existence and necessity of a 'general' legislative Power of the State, considering the inability to believe equal the position of State and Regions (especially in light of the provisions in art. 114 of the Constitution), and considering too what dictated by art. 118 of the Constitution in terms of "vertical subsidiarity". The findings are then applied to the 'matter' of the 'public contracts', using as parameter of judgment even the use that the Constitutional Court makes of the 'matter': "protection of competition".
Il concetto di "materie" nell'art. 117, titolo V, Cost.. Se i "lavori pubblici" e gli "appalti pubblici" si prestino ad esservi riportati e come si attui, per essi, il riparto di competenze tra enti.
