The thesis aims to systematically examine shared administration, drawing on the elements suitable on the one hand to qualify it as an administrative model in the full sense, and on the other to underline how this model expresses itself mainly in the context of local autonomies. Having analyzed the implications of the constitutional principle of horizontal subsidiarity, as the main normative source, shared administration as such is identified through an examination of the tools with which it expresses itself in the legal system. Then, the analysis focuses on the main structural aspects of the aforementioned model, as it fits into the organization of local autonomies, taking into account the subjective component, the organizational structures and the object of the collaboration itself. Subsequently, the thesis develops a comparison between shared administration and the main administrative models, as well as the forms of participation relating to the drafting of public policies. Finally, in light of what has been acquired, evolutionary hypotheses are put forward with reference to a possible legislative intervention, a rethinking of the administrative organization in a subsidiary key and a greater involvement of large-area entities, to encourage a scale dimension of the phenomenon. In all the passages stated, a special space is dedicated to a comparative analysis with other European legal systems, especially with the Spanish and French systems.
La tesi si propone di esaminare in maniera sistematica l’amministrazione condivisa, traendo gli elementi atti da un lato a qualificarla come modello amministrativo in senso pieno, dall’altro a rimarcare come tale modello si estrinsechi precipuamente nel contesto delle autonomie locali. Analizzato il portato del principio costituzionale di sussidiarietà orizzontale, quale principale fonte normativa, viene enucleata l’amministrazione condivisa in quanto tale, attraverso una disamina degli strumenti con cui essa si estrinseca nell’ordinamento giuridico. Quindi, si passano in rassegna i principali aspetti strutturali del suddetto modello nel suo calarsi all’interno dell’organizzazione delle autonomie locali, con riferimento alla componente soggettiva, agli assetti organizzativi e all’oggetto della collaborazione. Segue poi un raffronto tra l’amministrazione condivisa e i principali modelli amministrativi invalsi, nonché le forme di partecipazione afferenti alla formulazione delle politiche pubbliche. Da ultimo, alla luce di quanto acquisito, si avanzano ipotesi evolutive con riferimento a un possibile intervento legislativo, a un ripensamento dell’organizzazione amministrativa in chiave sussidiaria e a un maggiore coinvolgimento degli enti di area vasta, per incentivare una dimensione di scala del fenomeno. In tutti i passaggi enunciati, un apposito spazio è dedicato a un’analisi in chiave comparatistica con altri ordinamenti giuridici europei, in particolare con l’ordinamento spagnolo e quello francese.
