The concept of logical or “baconian” probability that comes out of the domestic Supreme Court’s recent decisions shows a peculiar historical and speculative background. This probability, indeed, exactly as “baconian”, can be traced back to the dialectical context of the “Socratic induction” that proceeds confutatively, through exclusions and eliminations, to the individuation of results having the highest degree of rational credibility.
