Il matrimonio dei cristiani 'in partibus infidelium'. Discussioni dottrinali dopo il concilio di Trento

After the council of Trent, theologians and canonists discussed whether the Cristians, who lived in a parish in which the Tametsi had been received, could marry without the parish priest if they were to live among the infidels. Apart from the absolutely minority position of Pedro de Ledesma, who considers marriage invalid, the most assert its validity because among the infidels there are no parishes or parish priests and certainly the Tridentine decree has not been published: some require Christians to have their quasi-domicile there, others say that it is enough even if they pass through those places or that they are there per modum hospitii, since the contract requires the solemnity of the place of the contract. Other authors believe that marriage is valid because the norm must apply in this case for epicheia.
