The comment critically discusses three judgments of the Italian Supreme Court of Cassazione holding that a decision of the Court of appeal establishing the jurisdictional competence of Italian courts and remanding the decision on the merits to the court of first instance under Article 353(1) c.p.c. has to be qualified as a «non final judgment » (sentenza non definitiva), and consequently may not be appealed immediately to the Supreme Court pursuant to Article 360(3) c.p.c.
