The essay analyses the most recent case-law of the Italian Constitutional Court (ICC) concerning the incompatibility between domestic and EU law on fundamental rights. The Author points out that the new orientation of the ICC, moving away from the reference to the EU Charter of Fundamental Rights to include the whole EU law, could generate potentially conflicting implications. In the last part of the contribution, the A. suggests that the interpretative approach adopted by the ICC, as it is based on a renewed dialogue with the European Court of Justice (ECJ), might already contain antidotes capable of preventing the development of such possible negative consequences.
