The Note addresses in a critical way the decision of the Cassazione regarding the lawfuness of publication of images relating facts and events held in public, arguing that the correct interpretation of the rules requires the public interest in the knowledge of the fact and not the mere presence of the persons in a public area, especially when the image published is that of a child.
