Miteigentum an Gebäuden und energiesparende Maßnahmen nach italienischem Recht

In Italien ist die Regelung des Kondominiums durch die Novelle von 2012 reformiert worden. Im Rahmen der Reform wurden ua neue Regeln bezüglich der Beschlussfähigkeit der Versammlung und der Gültigkeit ihrer Beschlüsse eingeführt. Der italienische Gesetzgeber hat sich bei der Bestimmung der Quoten für ein gemischtes System entschieden, wonach die Stimmengewichtung sowohl nach Köpfen als auch nach Eigentumsanteilen erfolgt. Sonderregeln gelten für Beschlüsse über CO2-sparende Investitionen, ua für diejenigen über die Installation von Ladestationen und -infrastruktur für Elektroautos. / In 2012 the Italian legislator updated the law on condominium. He changed inter alia the rules on the quorums required in order to convene and to adopt resolutions within the assembly. As regards the assembly resolutions, Italy opted for a mixed system: the majority is calculated on quota as well as on a per-capita basis. Specific rules apply to resolutions, which aim at increasing the energy efficiency and/or at reducing CO2 emissions, also through installation of home charging points and infrastructures for electric cars. The complexity of the existing law makes its interpretation and application not easy. One could also ask, how resolutions going to increase the energy efficiency and/or to save CO2 should be adopted, when the rights of single participants are involved.
